Terms & Conditions

1. ABOUT THESE TERMS

1.1 These Terms & Conditions govern bookings for accommodation, retreat programmes, activities and related services provided at Ocean Mantra Village in East Sumbawa, Indonesia.

1.2 Ocean Mantra Village is operated by:

1.3 In these Terms, the expressions “Ocean Mantra Village”, “Ocean Mantra”, “we”, “us” and “our” refer to the company identified above.

1.4 The expressions “Guest”, “you” and “your” refer to the person making the Booking and, where the context requires, each person included in or participating under that Booking.

1.5 Please read these Terms carefully before making any payment. By completing a Booking, you confirm that you have read, understood and agreed to these Terms.

2. DOCUMENTS FORMING THE AGREEMENT

2.1 The agreement between Ocean Mantra Village and the Guest consists of:

2.1.1 the Booking Confirmation issued by Ocean Mantra Village;

2.1.2 these Terms & Conditions;

2.1.3 the Cancellation & Refund Policy applicable to the Booking;

2.1.4 any special terms expressly agreed in writing between Ocean Mantra Village and the Guest; and

2.1.5 the Essential Safety & House Guidelines applicable during the stay.

2.2 The Privacy Policy explains how personal information is collected and processed but does not replace these Terms.

2.3 Guests may also be required to complete additional documents relating to health, safety or participation, including the Guest Registration, General Consent & Acknowledgement of Risk and, where applicable, the Water Activities Health Declaration & Safety Agreement.

2.4 If there is any inconsistency between the documents forming the agreement:

2.4.1 any specific terms stated in the Booking Confirmation will take priority over general provisions in these Terms;

the Cancellation & Refund Policy will take priority in relation to cancellations, credits and refunds; and

these Terms will apply in all other respects.

2.5 Nothing in any document limits any right or liability that cannot lawfully be limited or excluded.

3. BOOKING REQUESTS AND FORMATION OF THE CONTRACT

3.1 A request submitted through the website, by email, WhatsApp, telephone or through another communication channel is a request to make a Booking and does not by itself create a binding contract.

3.2 A Booking becomes binding only when:

3.2.1 Ocean Mantra Village has confirmed availability and the applicable price and payment terms;

3.2.2 the Guest has paid the deposit, prepayment or full amount required for that Booking; and

3.2.3 Ocean Mantra Village has issued a written Booking Confirmation.

3.3 Ocean Mantra Village may decline a booking request before issuing the Booking Confirmation, including where accommodation is unavailable, the requested programme is full, applicable eligibility requirements are not satisfied, or the proposed stay cannot reasonably be provided.

3.4 The Guest must check the Booking Confirmation promptly and notify Ocean Mantra Village without unreasonable delay if any information is incorrect.

4. BOOKING ON BEHALF OF OTHER GUESTS

4.1 A person making a Booking on behalf of another Guest confirms that they:

4.1.1 are authorised to make the Booking and provide the relevant information on that Guest’s behalf;

4.1.2 have provided each Guest with access to these Terms and the applicable Cancellation & Refund Policy; and

4.1.3 will ensure that each Guest is informed of any health, safety, age, conduct or participation requirements applicable to the stay.

4.2 Each adult Guest remains individually responsible for complying with these Terms and with the safety and conduct requirements applying at Ocean Mantra Village.

4.3 Any health declaration, consent, photography permission or acknowledgement of risk that requires an individual decision must be completed separately by the relevant Guest and may not be accepted on that Guest’s behalf, except where legally permitted.

5. DEFINITIONS

5.1 For the purposes of these Terms:

5.1.1 “Booking” means a confirmed reservation for accommodation, a retreat programme, activities or related services at Ocean Mantra Village.

5.1.2 “Booking Confirmation” means the written confirmation issued by Ocean Mantra Village setting out the principal details of the Booking, including the dates, Guest details, accommodation category, price, payment schedule and any special terms.

5.1.3 “Guest” means each person included in or participating under a Booking.

5.1.4 “Lead Guest” means the person who makes the Booking, communicates with Ocean Mantra Village and, where applicable, makes payment on behalf of the other Guests included in the Booking.

5.1.5 “Retreat” means the programme, accommodation, meals, practices, activities and other services described in the relevant Booking Confirmation or retreat description.

5.1.6 “Retreat Programme” means the schedule of optional practices, sessions, workshops, excursions or activities offered during the stay.

5.1.7 “Third-Party Provider” means an independent provider of transportation, excursions, boat services, massage, instruction, guiding or other external services.

5.1.8 “Force Majeure Event” means an event beyond the reasonable control of Ocean Mantra Village, as further described in these Terms and the Cancellation & Refund Policy.

6. NATURE AND SCOPE OF THE SERVICES

6.1 Ocean Mantra Village is an oceanfront retreat centre located in a remote natural coastal environment in East Sumbawa, Indonesia.

6.2 Depending on the Booking, the services may include:

6.2.1 accommodation;

6.2.2 meals and non-alcoholic beverages;

6.2.3 access to designated areas and facilities;

6.2.4 yoga, meditation, breathwork, movement or wellness sessions;

6.2.5 workshops, group practices or guided experiences;

6.2.6 swimming, surface snorkeling or other recreational activities;

6.2.7 excursions, transportation or boat activities; and

6.2.8 other services expressly listed in the Booking Confirmation.

6.3 The exact services included in a Booking are determined exclusively by the Booking Confirmation and the retreat description applicable at the time of booking.

6.4 The use of terms such as “all-inclusive”, “retreat package” or similar expressions does not mean that every service, activity, transfer, treatment, excursion or personal expense is included. These expressions refer only to the services expressly identified as included in the relevant Booking.

6.5 Ocean Mantra Village does not provide medical treatment, medical supervision, psychotherapy, psychiatric care, clinical diagnosis or emergency medical services.

6.6 Wellness practices, meditation, breathwork, movement sessions and similar activities are offered for general well-being and personal experience. They are not intended to replace professional medical, psychological or therapeutic advice, diagnosis or treatment.

7. RETREAT PROGRAMME AND SCHEDULE

7.1 The Retreat Programme may be provided in the form of a general or indicative schedule.

7.2 The timing, sequence, location, duration, teacher, instructor, facilitator or format of individual sessions may be changed where reasonably necessary because of:

7.2.1 weather or sea conditions;

7.2.2 health or safety considerations;

7.2.3 availability of facilitators or Third-Party Providers;

7.2.4 group size or participant needs;

7.2.5 local conditions, transport or infrastructure;

7.2.6 maintenance, operational or logistical requirements; or

7.2.7 any other circumstance reasonably affecting the proper delivery of the Retreat.

7.3 A change to the schedule, facilitator or format of an individual activity does not constitute a cancellation of the Booking where the overall nature and principal value of the Retreat remain substantially unchanged.

7.4 Participation in Retreat Programme activities is voluntary. A Guest may decline, pause or stop participation in an activity at any time.

7.5 Non-participation in an activity, whether by personal choice, health condition, late arrival, early departure or failure to meet applicable safety requirements, does not entitle the Guest to a refund, reduction in price or substitute service, except where required by applicable law or expressly agreed in writing.

8. PRICES, CURRENCY, TAXES AND CHARGES

8.1 Unless otherwise stated, prices are quoted in Indonesian Rupiah.

8.2 Where a price is displayed or communicated in another currency, that currency will apply only if it is expressly stated as the payment currency in the Booking Confirmation.

8.3 Prices may be stated as inclusive or exclusive of applicable taxes, government levies, service charges or similar mandatory charges. The Booking Confirmation will specify the charges included in the confirmed price and, where applicable, any additional charges payable by the Guest.

8.4 Ocean Mantra Village may amend its prices, packages or promotional offers at any time before a Booking is confirmed.

8.5 Once the Booking Confirmation has been issued, the confirmed price will remain applicable to that Booking, except where:

8.5.1 the Guest requests or agrees to a change;

8.5.2 additional services are purchased;

8.5.3 the number of Guests, accommodation category, dates or scope of services changes;

8.5.4 a tax, government levy or mandatory official charge is introduced or increased after the Booking is confirmed; or

8.5.5 the Booking Confirmation contains an obvious pricing, calculation or system error.

8.6 If an obvious error is identified, Ocean Mantra Village will notify the Guest promptly and offer the option to confirm the Booking at the correct price or cancel the affected Booking and receive a refund of the amount paid for it.

9. DEPOSIT AND PAYMENT TERMS

9.1 Unless different payment terms are stated in the Booking Confirmation, a deposit equal to 20% of the total Booking price is required to secure the Booking.

9.2 The remaining 80% balance is payable in full upon check-in.

9.3 The deposit is non-refundable except where:

9.3.1 the Cancellation & Refund Policy expressly provides otherwise;

9.3.2 Ocean Mantra Village cancels the Booking in circumstances requiring a refund; or

9.3.3 applicable law requires a refund.

9.4 Different payment terms may apply to certain categories of Booking, including:

9.4.1 peak-season stays;

9.4.2 group bookings;

9.4.3 private buyouts or exclusive-use bookings;

9.4.4 long stays;.

9.4.5 special events;

9.4.6 promotional or discounted rates; and

9.4.7 customised retreats or services reserved specifically for the Guest.

9.5 Such terms may require a higher deposit, staged payments, earlier payment deadlines or full prepayment before arrival.

9.6 Any special payment terms communicated before payment and recorded in the Booking Confirmation form part of the agreement and take priority over the general payment schedule stated above.

9.7 Payment must be made by the method and before the deadline specified by Ocean Mantra Village.

9.8 The Guest is responsible for bank charges, transfer fees, card processing fees, currency conversion costs and similar payment costs, unless Ocean Mantra Village expressly agrees otherwise.

9.9 A payment is treated as received only when cleared funds are credited to the account designated by Ocean Mantra Village.

9.10 If the Guest does not make a required payment by the applicable deadline, Ocean Mantra Village may:

9.10.1 request immediate payment;

9.10.2 suspend preparation or performance of the Booking;

9.10.3 release the reserved accommodation or services;

9.10.4 refuse check-in or participation; or

9.10.5 cancel the Booking in accordance with the Cancellation & Refund Policy.

9.11 Amounts already paid will be dealt with under the Cancellation & Refund Policy and applicable law.

10. SERVICES INCLUDED IN THE BOOKING

10.1 Only the services expressly identified as included in the Booking Confirmation are included in the Booking price.

10.2 Depending on the selected package, included services may comprise:

10.3 accommodation in the confirmed room category;

10.4 meals served according to the retreat’s meal programme;

10.5 non-alcoholic beverages specified in the package;

10.6 scheduled group sessions and practices;

10.7 use of designated common areas and facilities;

10.8 specified transfers, excursions or activities; and

10.9 other services expressly described as included.

10.10 Descriptions, images and schedules published on the website or in promotional materials are intended to provide a general representation of the experience. Minor differences in rooms, views, furnishings, menus, instructors, schedules, facilities or activities may occur, provided that the essential nature of the confirmed service is not materially reduced.

11. SERVICES AND COSTS NOT INCLUDED

11.1 Unless expressly included in the Booking Confirmation, the following are not included:

11.1.1 international or domestic flights;

11.1.2 visas, permits or immigration requirements;

11.1.3 travel, medical, cancellation or other insurance;

11.1.4 medical treatment, medication, testing, evacuation or repatriation;

11.1.5 transport to or from Ocean Mantra Village;

11.1.6 private sessions, massages, treatments or personal services;

11.1.7 optional excursions, boat trips or specialist activities;

11.1.8 equipment rental or replacement;

11.1.9 personal purchases, laundry, telephone or data charges;

11.1.10 bank, card or currency exchange fees;

11.1.11 gratuities; and

11.1.12 any other service not expressly identified as included.

11.2 Guests are responsible for arranging and paying for all excluded services and personal expenses.

12. AGE REQUIREMENTS

12.1 Ocean Mantra Village generally accepts Guests aged 16 and above.

12.2 Guests under the age of 16 are not permitted to attend or stay at Ocean Mantra Village unless Ocean Mantra Village expressly approves an exception in writing before the Booking is confirmed.

12.3 A Guest aged 16 or 17 may attend only:

12.3.1 with the prior written approval of Ocean Mantra Village;

12.3.2 when accompanied throughout the stay by a parent or legal guardian; and

12.3.3 where any requested consent, identification or supporting documentation has been provided.

12.4 The parent or legal guardian is responsible for the minor’s supervision, conduct, safety and compliance with these Terms.

12.5 Ocean Mantra Village may impose a minimum age of 18 for particular activities, including breath-hold practices, underwater meditation, freediving or other activities involving increased risk.

12.6 Where an activity is subject to a separate age requirement, that requirement will prevail regardless of the general minimum age for staying at Ocean Mantra Village.

13. HEALTH, FITNESS AND SUITABILITY

13.1 Each Guest is responsible for considering whether the stay, the remote location and the activities they intend to join are suitable for their individual health, fitness, mobility and personal circumstances.

13.2 Before making a Booking, and again before participating in an activity, a Guest should consult a qualified physician or other appropriate healthcare professional if they:

13.2.1 have any doubt about their ability to participate safely;

13.2.2 have been advised to restrict travel, physical activity, breathwork, swimming, diving, heat exposure or other relevant activity;

13.2.3 have recently undergone surgery or experienced a significant injury or illness; or

13.2.4 have a condition that may be affected by travel to a remote location or delayed access to medical care.

13.3 Ocean Mantra Village is not a healthcare provider. Its owners, employees, facilitators, instructors and contractors do not provide medical diagnosis, medical treatment, psychiatric treatment, psychotherapy or clinical supervision unless a service is expressly provided by an appropriately licensed professional and identified as such in writing.

13.4 No statement made by a facilitator, instructor or team member should be treated as medical advice or as confirmation that an activity is medically suitable for a particular Guest.

14. HEALTH AND SAFETY DISCLOSURE

14.1 Guests must provide honest, accurate and sufficiently complete information about any medical, psychological, physical or other condition that may:

14.1.1 affect their ability to travel to or stay at Ocean Mantra Village safely;

14.1.2 affect their ability to participate safely in an activity;

14.1.3 require adaptation, supervision, medication or special support;

14.1.4 create a foreseeable risk to the Guest or another person; or

14.1.5 affect Ocean Mantra Village’s ability to respond appropriately in an emergency.

14.2 Relevant circumstances may include, without limitation:

14.2.1 cardiovascular or blood pressure conditions;

14.2.2 respiratory conditions, asthma or breathing difficulties;

14.2.3 epilepsy, seizures, fainting or unexplained loss of consciousness;

14.2.4 recent surgery, significant injury or restricted mobility;

14.2.5 pregnancy or possible pregnancy;

14.2.6 severe allergies or medically necessary dietary restrictions;

14.2.7 panic attacks, severe anxiety or another condition that may be triggered by water, breathwork, confined

14.2.8 environments, isolation or intensive practice;

14.2.9 psychiatric or psychological conditions requiring ongoing professional supervision;

14.2.10 medication that may affect alertness, breathing, blood pressure, coordination, balance or judgment; and

14.2.11 any medical advice restricting travel, physical activity, water activities, fasting, heat exposure or breath-holding.

14.3 Disclosure must be made as early as reasonably possible and, where relevant, before the Booking is confirmed.

14.4 Guests must promptly notify Ocean Mantra Village if previously provided information changes before or during the stay.

14.5 Ocean Mantra Village will use health information only for legitimate booking, accommodation, safety, participation and emergency purposes and will process it in accordance with its Privacy Policy and applicable data protection law.

15. MEDICAL CLEARANCE AND PARTICIPATION DECISIONS

15.1 Where reasonably necessary for safety, Ocean Mantra Village may request additional information or written medical clearance before confirming that a Guest may participate in a particular activity.

15.2 Providing medical clearance does not guarantee participation. A facilitator, instructor or manager may still modify, limit, postpone or refuse participation where there is a reasonable safety concern based on the Guest’s condition, the nature of the activity, local conditions or information available at the relevant time.

15.3 A Guest must not participate in an activity contrary to medical advice or while ill, injured, intoxicated, significantly fatigued, dehydrated, impaired by medication or otherwise unable to participate safely.

15.4 A Guest who fails to disclose material information, provides materially inaccurate information or disregards medical or safety restrictions may be refused participation or, where necessary to protect health or safety, required to leave the Retreat.

15.5 Any financial consequences will be determined under these Terms, the Cancellation & Refund Policy and applicable law. Nothing in this section excludes Ocean Mantra Village’s responsibility for its own acts or omissions where such responsibility cannot lawfully be excluded.

16. ACCESSIBILITY, MOBILITY AND PHYSICAL CONDITIONS

16.1 Ocean Mantra Village is located in a remote coastal and cliffside environment. Access to and movement around the property may involve:

16.1.1 numerous stairs and slopes;

16.1.2 steep, narrow, uneven, sandy, rocky or wet paths;

16.1.3 natural terrain and cliff edges;

16.1.4 beach and ocean access without paved or step-free routes;

16.1.5 limited lighting in certain outdoor areas;

16.1.6 tropical heat, rain, insects and wildlife; and

16.1.7 areas that cannot be reached by vehicle.

16.2 Ocean Mantra Village does not currently provide comprehensive accessibility infrastructure. Unless expressly confirmed otherwise in writing, the property does not offer step-free access throughout, lifts, wheelchair-accessible routes, adapted transportation or other facilities designed for Guests with substantial mobility limitations.

16.3 For this reason, Ocean Mantra Village may not be suitable for Guests who:

16.3.1 require wheelchair access or step-free access;

16.3.2 are unable to use stairs or walk safely on uneven or steep terrain;

16.3.3 require regular physical assistance with movement;

16.3.4 depend on immediate access to a vehicle or medical facility; or

16.3.5 have another condition that may make the location unsafe or impracticable for them.

16.4 Guests with reduced mobility, a disability or another relevant limitation must contact Ocean Mantra Village before making a Booking and provide sufficient information about their requirements.

16.5 Ocean Mantra Village will assess the request honestly and may decline a Booking where the Guest’s essential needs cannot reasonably or safely be accommodated.

16.6 No assistance, equipment, adapted room, accessible route or special arrangement is guaranteed unless expressly confirmed in writing in the Booking Confirmation.

16.7 Guests who require personal physical assistance must travel with an appropriate companion or carer. Ocean Mantra Village does not provide personal care or individual mobility assistance.

17. MEALS, FOOD ALLERGIES AND DIETARY REQUIREMENTS

17.1 Meals at Ocean Mantra Village are generally prepared and served communally, including in buffet form.

17.2 The same general selection of food is made available to all Guests. Ocean Mantra Village does not ordinarily operate a separate medical kitchen or prepare individually controlled meals for each Guest.

17.3 Depending on the applicable retreat programme, the buffet may include vegetarian dishes, seafood and other ingredients described in the relevant offer or Booking Confirmation.

17.4 All food is prepared, stored and served in a shared kitchen and buffet environment. Different foods and allergens may be handled in the same preparation and serving areas.

17.5 Ocean Mantra Village cannot guarantee:

17.5.1 completely allergen-free environment;

17.5.2 the absence of cross-contact or trace amounts of an allergen;

17.5.3 separately prepared meals;

17.5.4 exclusive use of cooking equipment, surfaces or serving utensils; or

the availability of a particular specialist or medical diet.

18. VOLUNTARY PARTICIPATION

18.1 Participation in all practices, sessions, workshops, excursions and activities is voluntary.

18.2 A Guest may decline to participate, request a modification, pause or stop an activity at any time.

18.3 Guests must act within their own abilities and immediately inform the relevant facilitator, instructor or team member of pain, dizziness, breathing difficulty, unusual fatigue, anxiety, emotional distress, discomfort or any other safety concern.

18.4 Ocean Mantra Village does not guarantee any particular physical, emotional, spiritual, therapeutic or personal result from attendance or participation.

18.5 A Guest’s personal decision not to participate, or inability to participate for reasons not caused by a failure of Ocean Mantra Village to provide the confirmed service, does not ordinarily entitle the Guest to a refund, price reduction or substitute activity.

18.6 Nothing in this section affects rights arising where a confirmed service has not been provided or has been materially changed.

19. ACTIVITIES REQUIRING ADDITIONAL CONSENT

19.1 Certain activities may be subject to additional eligibility requirements, health declarations, safety briefings, consents or acknowledgements of risk.

19.2 Guests wishing to participate in underwater meditation, breath-hold practice, freediving or another designated higher-risk activity must complete the applicable Water Activities Health Declaration & Safety Agreement before participation.

19.3 Completion of an additional document does not create an automatic right to participate.

19.4 Ocean Mantra Village or the relevant instructor may refuse, limit, modify or stop participation where reasonably necessary because of:

19.4.1 the Guest’s health, fitness, technique or conduct;

19.4.2 incomplete, inconsistent or concerning health information;

19.4.3 failure to follow instructions;

19.4.4 equipment issues;

19.4.5 weather, visibility, sea conditions or currents;group safety; or

19.4.6 another reasonable safety concern.

19.5 The Guest must follow all safety instructions and must not undertake breath-holding, underwater meditation, freediving or another restricted activity alone or outside the format approved by the instructor.

19.6 Guests must disclose all food allergies and medically relevant dietary requirements before making a Booking.

19.7 Ocean Mantra Village may provide general information about the planned menu and ingredients where reasonably available but cannot provide medical advice regarding the suitability of food for a particular Guest.

19.8 Guests with a severe, potentially life-threatening or highly sensitive food allergy should not make a Booking unless Ocean Mantra Village has expressly confirmed in writing, before payment, that the relevant requirement can be accommodated.

19.9 Where Ocean Mantra Village determines that it cannot safely accommodate a disclosed allergy or medical dietary requirement, it may decline the Booking.

19.10 A Guest who travels with a known allergy must:

19.11 carry all medication prescribed for that allergy, including emergency medication where applicable;

ensure that the medication is available and not expired;

inform the relevant team members upon arrival; and

exercise appropriate personal caution when selecting food from the buffet.

19.12 Disclosure of an allergy does not transfer responsibility for the Guest’s medical management to Ocean Mantra Village.

19.13 Nothing in this section excludes responsibility arising from Ocean Mantra Village’s own failure to exercise the standard of care required by applicable law.

20. REMOTE LOCATION AND LIMITED MEDICAL ACCESS

20.1 Ocean Mantra Village is located in a highly remote part of East Sumbawa, at a substantial distance from hospitals, clinics, pharmacies and other urban infrastructure.

20.2 Guests acknowledge that:

20.2.1 there is no hospital, medical clinic, doctor, nurse or ambulance service operated by Ocean Mantra Village;

20.2.2 a person holding current certified first-aid qualifications may not be present at the property at all times;

20.2.3 Ocean Mantra Village does not maintain a dedicated emergency vehicle, ambulance or medical evacuation service;

20.2.4 access to a suitable medical facility may require lengthy travel;

20.2.5 transport may depend on the availability of local vehicles, drivers, boats or external providers; and

response and travel times may be affected by weather, sea conditions, road conditions, darkness, fuel availability, communications, local infrastructure and other circumstances beyond Ocean Mantra Village’s reasonable control.

20.3 The remote nature of the location means that immediate professional medical treatment cannot be guaranteed.

20.4 Guests who require frequent medical supervision, rapid access to emergency care or proximity to a hospital or specialist facility should carefully consider whether Ocean Mantra Village is suitable for them before making a Booking.

20.5 Nothing in this section relieves Ocean Mantra Village of its obligation to take reasonable action within the resources and options actually available to it when it becomes aware of an emergency.

21. ILLNESS, INJURY AND EMERGENCY ASSISTANCE

21.1 If a Guest becomes ill, injured, unconscious or otherwise distressed, Ocean Mantra Village may take such reasonable action as is practicable in the circumstances.

21.2 Depending on the situation and the resources available, this may include:

21.2.1 contacting the Guest’s emergency contact;

21.2.2 contacting local medical or emergency services;

21.2.3 seeking assistance from a person with relevant training, where available;

21.2.4 arranging transportation using an available local vehicle, boat or Third-Party Provider;

21.2.5 assisting the Guest in communicating with their insurer or medical assistance provider; or

21.2.6 taking another reasonable step considered necessary for the Guest’s immediate safety.

21.3 Ocean Mantra Village does not represent that its owners, employees, facilitators, instructors or contractors are doctors, nurses, paramedics or licensed medical professionals.

21.4 Any immediate assistance provided by a person who is not a qualified medical professional is limited to assistance that the person reasonably believes they can provide safely in the circumstances.

21.5 Where the Guest is unconscious or unable to communicate, Ocean Mantra Village may act on the basis of the information available at the time and may contact the Guest’s emergency contact, insurer, medical provider or local authorities.

21.6 Ocean Mantra Village cannot guarantee:

21.6.1 that a vehicle, boat, driver or medical provider will be immediately available;

21.6.2 any particular emergency response time;

21.6.3 admission to or availability at a particular medical facility; or

21.6.4 the quality or outcome of treatment or assistance provided by an independent third party.

21.7 Unless the relevant cost results from a matter for which Ocean Mantra Village is legally responsible, the Guest is responsible for all costs connected with illness, injury or emergency assistance, including:

21.7.1 medical consultation and treatment;

21.7.2 medication and hospitalisation;

21.7.3 local transportation;

21.7.4 emergency evacuation;

21.7.5 air or sea evacuation;

21.7.6 repatriation; and

21.7.7 accommodation, travel or other related expenses.

22. TRAVEL AND MEDICAL INSURANCE

22.1 Guests are strongly advised to obtain comprehensive insurance before travelling.

22.2 The insurance should be appropriate for Indonesia, the remote location and the activities the Guest intends to undertake and should, where relevant, cover:

22.2.1 medical treatment and hospitalisation;

22.2.2 emergency transport and evacuation;

22.2.3 repatriation;

22.2.4 trip cancellation, curtailment and interruption;

22.2.5 delayed or cancelled transportation;

22.2.6 baggage and personal belongings;

22.2.7 water-based and other planned activities; and

22.2.8 any pre-existing condition for which coverage is required.

22.3 Each Guest is responsible for reviewing the terms, exclusions, territorial scope and activity limitations of their insurance.

22.4 Failure to obtain adequate insurance does not transfer the resulting financial responsibility to Ocean Mantra Village.

23. CHANGES REQUESTED BY THE GUEST

23.1 Any request to change a confirmed Booking must be submitted to Ocean Mantra Village in writing.

23.2 A requested change may include:

23.2.1 a change of arrival or departure date;

23.2.2 an extension or reduction of the stay;

23.2.3 a change of accommodation category;

23.2.4 a change in the number or identity of Guests;

23.2.5 a transfer of the Booking to another person; or

23.2.6 a change to an included service or agreed arrangement.

23.3 A requested change is not effective unless and until it has been expressly accepted in writing by Ocean Mantra Village.

23.4 Ocean Mantra Village will make reasonable efforts to accommodate a requested change but cannot guarantee that the requested dates, accommodation, programme or services will be available.

23.5 A change may result in:

23.5.1 an increase or decrease in the Booking price;

23.5.2 an administration or change fee disclosed before the change is confirmed;

23.5.3 the application of a different promotional rate or payment schedule;

23.5.4 charges imposed by a Third-Party Provider; or

23.5.5 the change being treated as a cancellation and new Booking where the original Booking cannot reasonably be amended.

23.6 Any additional amount must be paid by the deadline specified by Ocean Mantra Village

23.7 Where the amended Booking has a lower price, any credit or refund will be determined under the Cancellation & Refund Policy applicable to the original Booking, unless otherwise agreed in writing.

24. TRANSFER OF A BOOKING TO ANOTHER GUEST

24.1 A Guest may request permission to transfer a Booking to another person.

24.2 A transfer is permitted only where:

24.2.1 Ocean Mantra Village approves the transfer in writing;

24.2.2 the replacement Guest satisfies all age, health, suitability and participation requirements;

24.2.3 the request is made sufficiently before the arrival date to allow the necessary arrangements to be completed;

24.2.4 all outstanding amounts are paid; and

24.2.5 the original and replacement Guests provide all information and documents reasonably required for the transfer.

24.3 Ocean Mantra Village may refuse a transfer where the Booking is personalised, non-transferable, subject to specific eligibility requirements or connected with services that cannot be reassigned.

24.4 The original Guest and replacement Guest are jointly responsible for any outstanding balance and any reasonable additional costs directly arising from the transfer, unless otherwise agreed in writing.

24.5 A photography consent, health declaration, acknowledgement of risk or other individual consent given by the original Guest does not transfer to the replacement Guest. The replacement Guest must complete their own documents.

25. CANCELLATION BY THE GUEST

25.1 A Guest may cancel a Booking by sending a clear written cancellation notice to the contact address specified by Ocean Mantra Village.

25.2 The cancellation becomes effective when Ocean Mantra Village receives the notice.

25.3 Any refund, credit, rescheduling option, cancellation fee or amount retained following cancellation will be determined in accordance with:

25.3.1 the Cancellation & Refund Policy accepted at the time of Booking;

25.3.2 any special cancellation terms stated in the Booking Confirmation; and

25.3.3 applicable law.

25.4 The amount retained may depend on:

25.4.1 the time remaining before the scheduled arrival date;

25.4.2 whether the Booking was made at a refundable, non-refundable, promotional, group or private-buyout rate;

25.4.3 costs already reasonably incurred or committed in connection with the Booking;

25.4.4 charges imposed by Third-Party Providers; and

25.4.5 whether Ocean Mantra Village is reasonably able to resell the accommodation or place.

25.5 Where a Booking includes services provided by a Third-Party Provider, the cancellation terms of that provider may also apply if they were disclosed to the Guest before the relevant service was confirmed.

25.6 A Guest who does not wish to travel because of personal circumstances, including illness, injury, family circumstances, changes in work commitments, visa problems, flight changes or other personal travel disruption, remains subject to the applicable Cancellation & Refund Policy.

25.7 Guests should seek reimbursement from their insurer where the relevant event is covered by their policy.

25.8 Nothing in this section limits any refund or other remedy that must be provided under applicable law.

26. NON-REFUNDABLE AND PROMOTIONAL BOOKINGS

26.1 A Booking may be offered at a reduced, promotional or non-refundable rate.

26.2 Where a Booking is non-refundable or subject to special restrictions:

26.2.1 this must be communicated before payment;

26.2.2 the restriction must be stated in the Booking Confirmation or applicable offer; and

26.2.3 the restriction will apply only to the extent permitted by applicable law.

26.3 Unless otherwise stated, a non-refundable condition applies to cancellation initiated by the Guest. It does not remove the Guest’s rights where Ocean Mantra Village cancels the Booking, fails to provide the confirmed service or is legally required to make a refund.

27. FAILURE TO ARRIVE, LATE ARRIVAL AND EARLY DEPARTURE

27.1 A Guest who does not arrive on the confirmed arrival date and does not notify Ocean Mantra Village will be treated as a no-show.

27.2 In the case of a no-show, Ocean Mantra Village may cancel the remaining Booking and release the accommodation and reserved services.

27.3 Unless otherwise required by applicable law or expressly provided in the Cancellation & Refund Policy, no refund or credit will be provided for:

27.3.1 failure to arrive;

27.3.2 arrival after the confirmed date or check-in period;

27.3.3 unused nights;

27.3.4 missed meals, sessions or activities;

27.3.5 voluntary early departure; or

27.3.6 services not used because of the Guest’s personal travel arrangements, health, conduct or decision.

27.4 A Guest who expects to arrive late must notify Ocean Mantra Village as soon as reasonably possible.

27.5 Because access to the property is remote, arrival outside an agreed period may require additional transport or staffing arrangements and may be subject to an additional cost notified to the Guest.

27.6 Ocean Mantra Village does not guarantee that late-night or unscheduled transport to the property will be available.

28. TRAVEL ARRANGEMENTS AND ENTRY REQUIREMENTS

28.1 Unless expressly included in the Booking Confirmation, Guests are responsible for arranging their own:

28.1.1 international and domestic flights;

28.1.2 transportation to the agreed meeting or transfer point;

28.1.3 passport, visa and immigration requirements;

28.1.4 vaccinations, health documentation and entry requirements; and

28.1.5 sufficient connection and transfer time.

28.2 Guests must ensure that their passport, visa and other travel documents are valid for their intended travel.

28.3 Ocean Mantra Village is not responsible for a Guest’s inability to travel because of:

28.3.1 an invalid or insufficient passport;

28.3.2 refusal or delay of a visa or entry permission;

28.3.3 failure to comply with immigration, customs or health requirements;

28.3.4 missed, delayed or cancelled transportation; or

28.3.5 insufficient connection time arranged by the Guest.

28.4 Where Ocean Mantra Village provides general travel or route information, that information is provided as practical guidance and does not replace information from airlines, immigration authorities, consulates or other competent authorities.

29. CHANGES MADE BY OCEAN MANTRA VILLAGE

29.1 Ocean Mantra Village may make reasonable changes to the Retreat, programme, accommodation, facilities or services where necessary for operational, logistical, environmental, health or safety reasons.

29.2 Minor changes may include:

29.2.1 a change to the order or timing of activities;

29.2.2 substitution of a facilitator, teacher, instructor or guide;

29.2.3 relocation of an activity within or near the property;

29.2.4 modification of a menu or buffet item;

29.2.5 temporary unavailability of a non-essential facility;

29.2.6 adjustment of an activity because of weather or sea conditions; or

29.2.7 replacement of an included service with a reasonably comparable alternative.

29.3 Minor changes do not entitle the Guest to cancel without charge or receive a refund where the overall nature and principal value of the confirmed Retreat remain substantially unchanged

29.4 Ocean Mantra Village will inform the Guest of a material change as soon as reasonably possible.

29.5 A material change means a change that substantially affects a principal element of the confirmed Booking, such as:

29.5.1 a significant change to the confirmed dates;

29.5.2 inability to provide accommodation of a reasonably comparable standard;

29.5.3 removal of a principal element of the Retreat without a reasonable alternative; or

29.5.4 a substantial reduction in the overall duration or value of the confirmed services.

29.6 Where Ocean Mantra Village makes a material change before arrival, it will offer the Guest, depending on the circumstances:

29.6.1 acceptance of the amended Booking;

29.6.2 a reasonably comparable alternative, where available;

29.6.3 rescheduling or a credit on terms agreed with the Guest; or

29.6.4 cancellation of the materially affected Booking and an appropriate refund.

29.7 The Guest must communicate their choice within the reasonable period specified by Ocean Mantra Village. If the Guest does not respond, Ocean Mantra Village will make reasonable efforts to contact them before determining the status of the Booking.

30. CANCELLATION BY OCEAN MANTRA VILLAGE

30.1 Ocean Mantra Village may cancel a Booking where:

30.1.1 it is unable to provide the confirmed stay or Retreat;

30.1.2 a minimum number of participants expressly required for a programme is not reached;

30.1.3 the property or a material part of it becomes unavailable or unsafe;

30.1.4 a facilitator essential to a specialised Retreat becomes unavailable and no reasonable substitute can be arranged;

30.1.5 the Guest has failed to make a required payment;

30.1.6 the Guest has provided materially false or incomplete information affecting safety or eligibility;

30.1.7 the Guest does not satisfy a disclosed condition of participation;

30.1.8 performance would breach applicable law or an order of a competent authority; or

30.1.9 a Force Majeure Event prevents or materially affects performance.

30.2 Where Ocean Mantra Village cancels for reasons not caused by the Guest and not arising from the Guest’s breach, it will offer the remedy required by the applicable Cancellation & Refund Policy and law, which may include:

30.2.1 rescheduling;

30.2.2 an alternative Retreat or stay;

30.2.3 a credit; or

30.2.4 a refund of amounts paid for services that will not be provided.

30.3 Where Ocean Mantra Village cancels because of the Guest’s non-payment, breach, ineligibility, unsafe conduct or materially inaccurate disclosure, the financial consequences will be determined under these Terms and the Cancellation & Refund Policy.

30.4 Ocean Mantra Village is not responsible for consequential or external costs such as flights, visas, onward accommodation or other independent travel arrangements, except where such responsibility cannot lawfully be excluded.

30.5 For this reason, Guests must maintain appropriate travel and cancellation insurance.

30.6

31. FORCE MAJEURE

31.1 A Force Majeure Event means an event or circumstance beyond the reasonable control of Ocean Mantra Village that prevents, significantly delays or materially affects the performance of the Booking.

31.2 Force Majeure Events may include:

31.2.1 earthquake, volcanic activity, tsunami, flood, landslide, fire or other natural disaster;

31.2.2 severe weather, dangerous sea conditions, storms or prolonged heavy rain;

31.2.3 epidemic, pandemic, public-health emergency or quarantine restriction;

31.2.4 war, armed conflict, terrorism, civil unrest or serious security threat;

31.2.5 government action, closure, restriction, evacuation order or change in law;

31.2.6 closure or serious disruption of airports, ports, roads, ferries or other transport infrastructure;

31.2.7 prolonged interruption of electricity, water, telecommunications or fuel supply;

31.2.8 industrial action not limited to Ocean Mantra Village’s own workforce;

31.2.9 serious damage to the property or essential infrastructure;

31.2.10 inability of essential Third-Party Providers to perform because of such an event; or

31.2.11 another comparable event that could not reasonably have been prevented or overcome.

31.3 Ocean Mantra Village will take reasonable steps to reduce the effect of a Force Majeure Event and will inform affected Guests as soon as reasonably practicable.

31.4 Depending on the nature, timing and duration of the event, Ocean Mantra Village may:

31.4.1 modify, postpone or suspend an activity;

31.4.2 change the Retreat schedule or location of a service;

31.4.3 provide a reasonable alternative;

31.4.4 reschedule the Booking;

31.4.5 issue a credit; or

cancel all or part of the Booking.

31.5 Any refund, credit or rescheduling arrangement will be determined in accordance with

31.5.1 the services that can or cannot be provided;

31.5.2 the Cancellation & Refund Policy;

31.5.3 amounts already reasonably and irreversibly paid to Third-Party Providers; and

31.5.4 applicable law.

31.6 This section does not permit Ocean Mantra Village to retain amounts where retention would be prohibited by applicable law.

32. REMOTE-ISLAND CONDITIONS AND SERVICE INTERRUPTIONS

32.1 Guests acknowledge that Ocean Mantra Village operates in a remote island environment where infrastructure and supplies may be less reliable than in an urban hotel or resort.

32.2 The stay may involve temporary interruptions or limitations affecting:

32.2.1 electricity;

32.2.2 water supply or water pressure;

32.2.3 hot water;

32.2.4 internet or mobile connectivity;

32.2.5 air-conditioning or fans;

32.2.6 food, fuel or other local supplies;

32.2.7 road access; or

32.2.8 transportation.

32.3 Ocean Mantra Village will take reasonable steps to maintain its services and respond to material interruptions.

32.4 A short-term or minor interruption that is inherent in the remote location and does not substantially reduce the overall accommodation or Retreat does not ordinarily entitle the Guest to compensation.

32.5 Where an interruption is substantial, prolonged and materially affects a principal element of the Booking, Ocean Mantra Village will consider an appropriate remedy having regard to:

32.5.1 the duration and seriousness of the interruption;

32.5.2 the services that remained available;

32.5.3 any alternative offered;

32.5.4 the cause of the interruption; and

32.5.5 applicable law.

32.6 Nothing in this section excludes Ocean Mantra Village’s responsibility for a failure to take reasonable preventive or corrective action within its control.

33. ARRIVAL AND CHECK-IN

33.1 Guests must arrive on the date and within the check-in period stated in the Booking Confirmation or otherwise agreed in writing.

33.2 Because Ocean Mantra Village is located in a remote area, travel to the property may require advance coordination. Guests must provide reasonably requested arrival information, including flight, ferry, vehicle or transfer details, within the period specified by Ocean Mantra Village.

33.3 A Guest who expects a delay or change in their travel arrangements must notify Ocean Mantra Village as soon as reasonably possible.

33.4 Check-in may be subject to:

33.4.1 verification of the Guest’s identity;

33.4.2 presentation of a valid passport or other accepted identification;

33.4.3 completion of registration and safety documentation;

33.4.4 payment of any outstanding Booking balance or authorised charges;

33.4.5 provision of emergency contact details;

33.4.6 confirmation of mandatory travel and medical insurance; and

33.4.7 completion of any health declaration or activity-specific consent required for the stay.

33.5 Ocean Mantra Village may refuse or delay check-in where:

33.5.1 the Guest cannot establish their identity or entitlement to the Booking;

33.5.2 a required payment remains outstanding;

33.5.3 the Guest refuses to complete a mandatory registration or safety document;

33.5.4 the Guest has not satisfied a material eligibility or insurance requirement disclosed before the Booking;

33.5.5 the Guest appears seriously intoxicated, aggressive or unable to enter the property safely;

33.5.6 the number or identity of arriving Guests does not correspond with the confirmed Booking; or

33.5.7 check-in would otherwise breach applicable law or create a material safety risk.

33.6 Ocean Mantra Village will act reasonably when exercising this right. Any resulting cancellation, refund or retention of payment will be determined under these Terms, the Cancellation & Refund Policy and applicable law.

34. GUEST REGISTRATION AND REQUIRED INFORMATION

34.1 Each Guest must provide accurate and complete information reasonably required for:

34.1.1 registration and accommodation administration;

34.1.2 compliance with applicable legal or reporting obligations;

34.1.3 health and safety management;

34.1.4 dietary arrangements;

34.1.5 emergency contact purposes; and

34.1.6 participation in particular activities.

34.2 Guests must promptly notify Ocean Mantra Village if any relevant information changes.

34.3 Ocean Mantra Village may require each adult Guest to complete and sign the Guest Registration, General Consent & Acknowledgement of Risk upon or before arrival.

34.4 Completion of that document supplements these Terms but does not remove or reduce any right or liability that cannot lawfully be excluded.

34.5 A Guest who wishes to participate in a designated higher-risk activity may also be required to complete a separate health declaration, safety agreement or acknowledgement of risk.

35. HOUSE AND SAFETY GUIDELINES

35.1 Guests must comply with:

35.1.1 these Terms;

35.1.2 the Essential Safety & House Guidelines;

35.1.3 instructions displayed or communicated at the property;

35.1.4 reasonable directions given by Ocean Mantra Village staff, facilitators, instructors, guides, drivers or boat crew; and

35.1.5 applicable Indonesian law.

35.2 The Essential Safety & House Guidelines may include practical rules concerning:

35.2.1 use of rooms, common areas and facilities;

35.2.2 access to beaches, cliffs, paths, the pool and the ocean;

35.2.3 designated swimming or snorkeling areas;

35.2.4 quiet hours;

35.2.5 waste, wildlife and environmental protection;

35.2.6 use of equipment;

35.2.7 food and buffet arrangements;

35.2.8 smoking, vaping, alcohol and prohibited substances;

35.2.9 visitors and unauthorised persons; and

35.2.10 emergency procedures.

35.3 Ocean Mantra Village may update practical house or safety instructions where reasonably necessary to respond to operational, environmental or safety conditions.

35.4 A material change affecting a confirmed service remains subject to the change provisions in these Terms.

36. PERSONAL SAFETY AND FOLLOWING INSTRUCTIONS

36.1 Guests must exercise reasonable care for their own safety and the safety of others.

36.2 Guests must:

36.2.1 use only authorised areas, routes and facilities;

36.2.2 follow warnings, signs, barriers and safety briefings;

36.2.3 remain within any designated swimming, snorkeling or activity area;

36.2.4 use equipment only for its intended purpose;

36.2.5 immediately report hazards, defects, injury or safety concerns;

36.2.6 avoid cliff edges, dangerous sea conditions and restricted areas;

36.2.7 take appropriate care on stairs, slopes, wet surfaces and uneven terrain; and

36.2.8 comply promptly with reasonable instructions to stop, modify or leave an activity.

36.3 Guests must not:

36.3.1 enter a restricted or closed area;

36.3.2 undertake a supervised activity without authorisation;

36.3.3 use equipment they are not competent or permitted to use;

36.3.4 swim, snorkel, dive or enter the water contrary to instructions or when conditions are unsafe;

36.3.5 interfere with safety equipment; or

36.3.6 encourage another person to disregard a safety instruction.

36.4 Ocean Mantra Village may close an area, restrict access, suspend an activity or require a Guest to leave a location where reasonably necessary for safety.

37. ALCOHOL, ILLEGAL DRUGS, SMOKING AND IMPAIRMENT

37.1 Ocean Mantra Village is intended to be an alcohol-free and substance-free retreat environment.

37.2 Unless Ocean Mantra Village expressly states otherwise in writing:

37.2.1 Guests must not bring, consume, distribute or sell alcohol on the property;

37.2.2 Guests must not possess, use, distribute or sell illegal drugs or prohibited psychoactive substances;

37.2.3 smoking and vaping are prohibited throughout the property; and

37.2.4 Guests must not participate in any activity while impaired by alcohol, drugs, medication, exhaustion, illness or another condition affecting judgment, coordination or safety

37.3 Nothing in this section prohibits a Guest from carrying or using lawfully prescribed or permitted medication in accordance with medical instructions.

37.4 However, a Guest must inform the relevant instructor or team member where medication may materially affect alertness, breathing, blood pressure, coordination, balance or judgment in relation to an activity.

37.5 Ocean Mantra Village may refuse participation, require a Guest to return to their room, request medical assessment or end the stay where impairment creates a material risk or seriously disrupts the retreat environment.

37.6 The possession, use or supply of substances prohibited under Indonesian law may be reported to the competent authorities.

38. GUEST CONDUCT

38.1 Guests must behave respectfully toward:

38.1.1 other Guests;

38.1.2 staff, facilitators, instructors and Third-Party Providers;

38.1.3 residents and members of the local community;

38.1.4 the property and facilities;

38.1.5 wildlife, marine life and the natural environment; and

38.1.6 local customs, laws and cultural expectations.

38.2 Guests must not engage in:

38.2.1 violence, threats, intimidation or aggressive conduct;

38.2.2 harassment, bullying, stalking or unwanted sexual conduct;

38.2.3 discriminatory, abusive or degrading behaviour;

38.2.4 conduct that seriously disturbs the peace, privacy or well-being of others;

38.2.5 deliberate or reckless damage to property;

38.2.6 theft or unauthorised use of another person’s belongings;

38.2.7 dangerous conduct or repeated disregard of safety instructions;

38.2.8 unauthorised commercial, promotional or organised activity; or

38.2.9 behaviour that is unlawful or materially incompatible with the retreat environment.

38.3 Guests must respect reasonable requests concerning quiet, privacy, shared spaces and group activities.

39. WARNINGS, RESTRICTIONS AND REMOVAL OF A GUEST

39.1 Where reasonably appropriate, Ocean Mantra Village may respond to misconduct or a breach by:

39.1.1 giving a verbal or written warning;

39.1.2 requiring the Guest to stop the conduct;

39.1.3 restricting access to an activity, facility or area;

39.1.4 requiring additional supervision or conditions;

39.1.5 contacting the Guest’s emergency contact;

39.1.6 requiring the Guest to leave the property; or

39.1.7 contacting local authorities.

39.2 Ocean Mantra Village may require immediate departure without a prior warning where the Guest’s conduct:

39.2.1 creates a serious or immediate risk to health or safety;

39.2.2 involves violence, threats, serious harassment or illegal activity;

39.2.3 involves prohibited drugs or serious intoxication;

39.2.4 causes or threatens substantial property damage;

39.2.5 seriously affects another Guest, staff member or local resident; or

39.2.6 makes continued accommodation unreasonable.

39.3 Where a Guest is required to leave because of their serious misconduct or material breach:

39.3.1 the Guest is responsible for arranging and paying for their departure, alternative accommodation and onward travel;

39.3.2 Ocean Mantra Village may provide reasonable assistance in arranging transport where practicable but does not guarantee immediate transport availability; and

39.3.3 unused services will not ordinarily be refunded, subject to the Cancellation & Refund Policy and applicable law.

39.4 Ocean Mantra Village will not remove a Guest arbitrarily and will take account of the seriousness of the conduct, immediate safety needs and the circumstances reasonably known at the time.

40. VISITORS AND UNREGISTERED PERSONS

40.1 Only registered Guests and authorised persons may enter or stay at Ocean Mantra Village.

40.2 Guests must not invite an external visitor onto the property without prior permission.

40.3 Ocean Mantra Village may require:

40.3.1 advance identification of the visitor;

40.3.2 registration at reception or with the relevant manager;

40.3.3 compliance with house and safety requirements;

40.3.4 payment of an applicable visitor or service fee; and

40.3.5 departure by a specified time.

40.4 An overnight stay by an unregistered person is prohibited unless Ocean Mantra Village has approved and confirmed an amended Booking.

40.5 The Guest who invites or introduces a visitor is responsible for ensuring that the visitor complies with applicable rules and may be responsible for loss or damage caused by that visitor to the extent permitted by law.

41. ROOMS, FACILITIES AND PROPERTY

41.1 Guests must use accommodation, furnishings, equipment and facilities with reasonable care and only for their intended purpose.

41.2 Guests must not:

41.2.1 move, dismantle or modify equipment or furnishings without permission;

41.2.2 remove property from the premises;

41.2.3 make alterations to a room or facility;

41.2.4 use candles, open flames or unauthorised heating or cooking devices;

41.2.5 interfere with electrical, water, communications or safety systems; or

41.2.6 cause avoidable damage, excessive cleaning requirements or unreasonable disturbance.

41.3 Guests must promptly report damage, breakage, malfunction or loss.

41.4 Ocean Mantra Village may enter a Guest’s room where reasonably necessary for:

41.4.1 cleaning, maintenance or repair;

41.4.2 responding to an emergency or suspected safety issue;

41.4.3 investigating a serious breach of these Terms;

41.4.4 preventing damage; or

41.4.5 complying with applicable law.

41.5 Except in an emergency or where immediate access is reasonably necessary, Ocean Mantra Village will seek to provide notice before entering an occupied room.

42. DAMAGE, LOSS AND ADDITIONAL CLEANING

42.1 A Guest may be required to reimburse Ocean Mantra Village for reasonable costs arising directly from:

42.1.1 intentional damage;

42.1.2 negligent or reckless damage;

42.1.3 failure to follow reasonable instructions;

42.1.4 loss or non-return of equipment, keys or other property;

42.1.5 unauthorised removal of property; or

42.1.6 cleaning materially exceeding what is normally required after a stay.

42.2 The amount charged must reflect the reasonable cost of repair, replacement, recovery or additional cleaning and must not operate as a penalty.

42.3 Where practicable, Ocean Mantra Village will provide information supporting a material charge.

42.4 The Lead Guest may be responsible for charges relating to their own conduct and, where lawfully agreed, for damage caused by other persons included in the same Booking. Each person remains responsible for their own intentional, negligent or unlawful conduct.

42.5 Ocean Mantra Village may charge an authorised payment method only where the Guest has validly authorised such a charge and the basis and amount of the charge can be reasonably demonstrated.

43. PERSONAL BELONGINGS

43.1 Guests are responsible for the safekeeping of their passports, money, electronic devices, jewellery, medication, documents and other personal belongings.

43.2 Guests should not bring unnecessary valuables to Ocean Mantra Village.

43.3 Where a safe, storage area or other security facility is available, its use does not constitute a guarantee against loss, theft or damage.

43.4 Ocean Mantra Village is not responsible for loss, theft or damage to personal property where the loss results from:

43.4.1 the Guest’s failure to exercise reasonable care;

43.4.2 leaving property unattended or unsecured;

43.4.3 inherent defects or normal wear;

43.4.4 weather, humidity, salt water, sand, insects or other natural coastal conditions;

43.4.5 transportation or handling by an independent Third-Party Provider; or

43.4.6 another circumstance beyond Ocean Mantra Village’s reasonable control.

43.5 Nothing in this section excludes responsibility for loss or damage caused by Ocean Mantra Village’s own intentional act, negligence or other matter for which liability cannot lawfully be excluded.

43.6 Guests must report missing or damaged property as soon as reasonably possible to allow the circumstances to be investigated.

44. LOST PROPERTY

44.1 Property found after departure may be stored for a reasonable period determined by Ocean Mantra Village.

44.2 Where the owner can be identified, Ocean Mantra Village may contact the Guest using the details provided for the Booking.

44.3 The Guest is responsible for the reasonable costs of packaging, delivery, insurance, customs or courier services connected with returning lost property.

44.4 Ocean Mantra Village does not guarantee that lost property can be located, stored indefinitely or delivered internationally.

44.5 Unclaimed property may be disposed of, donated or otherwise dealt with after a reasonable storage period, subject to applicable law.

45. THIRD-PARTY SERVICES

45.1 Certain transfers, excursions, boat services, treatments, activities or other services may be provided by independent Third-Party Providers.

45.2 Where a third-party service forms part of the confirmed Booking, Ocean Mantra Village will exercise reasonable care in arranging that service but is not responsible for matters outside its reasonable control

45.3 Where Ocean Mantra Village only provides information or contact details and the Guest contracts directly with the Third-Party Provider, the resulting agreement is between the Guest and that provider.

45.4 Third-party services may be subject to separate terms, schedules, safety rules and cancellation conditions.

46. PHOTOGRAPHY AND RECORDINGS

46.1 Ocean Mantra Village will not use a Guest’s recognisable image for promotional purposes without the Guest’s consent.

46.2 Consent may be granted or refused separately and may be withdrawn for future use by contacting Ocean Mantra Village.

46.3 Guests must respect the privacy of other Guests and must not publish recognisable photographs, recordings or private information concerning another person without their permission.

47. INTELLECTUAL PROPERTY

47.1 The Ocean Mantra Village name, branding, website content, retreat materials, photographs and programme materials are protected by applicable intellectual property laws.

47.2 Guests may use materials provided during the Retreat for their own personal and non-commercial purposes unless otherwise stated.

47.3 No material may be copied, sold, published, recorded or used commercially without prior written permission.

48. LIABILITY AND INHERENT RISKS

48.1 Ocean Mantra Village will exercise reasonable care in providing the confirmed accommodation and services.

48.2 Guests acknowledge that a stay in a remote coastal environment and participation in optional activities may involve inherent risks that cannot be completely eliminated, including risks associated with:

48.2.1 the ocean, beaches, rocks, cliffs and changing weather;

48.2.2 stairs, slopes, uneven or wet surfaces;

48.2.3 tropical heat, insects and wildlife;

48.2.4 swimming, snorkeling, boat travel and other water activities;

48.2.5 physical or emotional responses to retreat practices; and

48.2.6 delayed access to medical assistance.

48.3 Guests voluntarily accept the ordinary and inherent risks of the activities they choose to undertake.

48.4 Ocean Mantra Village is not responsible for loss, injury or expense arising solely from:

48.4.1 an inherent risk of the stay or activity;

48.4.2 the Guest’s failure to disclose relevant information;

48.4.3 disregard of reasonable safety instructions;

48.4.4 the Guest’s own unlawful, reckless or negligent conduct; or

48.4.5 an event beyond Ocean Mantra Village’s reasonable control.

49. LIABILITY THAT CANNOT BE EXCLUDED

49.1 Nothing in these Terms excludes or limits liability:

49.1.1 where exclusion or limitation is prohibited by applicable law;

49.1.2 for fraud or intentional misconduct;

49.1.3 for gross negligence where liability cannot lawfully be limited; or

49.1.4 for the failure to provide rights or remedies that are mandatory under applicable consumer law.

49.2 Any limitation of liability in these Terms applies only to the fullest extent permitted by law.

50. GUEST RESPONSIBILITY

50.1 A Guest is responsible for reasonable loss, damage or cost directly caused by their intentional, unlawful, negligent or reckless conduct or by their material breach of these Terms.

50.2 A Guest is not responsible for indirect, remote or punitive amounts that do not reflect an actual and reasonably demonstrated loss.

51. COMPLAINTS

51.1 A Guest who experiences a problem must notify Ocean Mantra Village as soon as reasonably possible during the stay so that the issue can be assessed and, where possible, resolved.

51.2 If the matter is not resolved, the Guest should submit a written complaint containing:

51.2.1 the Guest’s name and Booking details;

51.2.2 a description of the issue;

51.2.3 when the issue occurred; and

51.2.4 the requested resolution.

51.3 Ocean Mantra Village will consider complaints in good faith and respond within a reasonable period.

51.4 Failure to report an issue during the stay may affect the possibility of obtaining a remedy where Ocean Mantra Village could reasonably have resolved the issue at that time.

52. PERSONAL DATA AND ELECTRONIC COMMUNICATIONS

52.1 Ocean Mantra Village may process personal information for booking, payment, accommodation, safety, emergency contact, legal compliance and service administration purposes.

52.2 Health information will be collected only where reasonably necessary for safety, accommodation or participation and will be handled in accordance with the Privacy Policy and applicable law.

52.3 Guests agree that booking confirmations, notices and other communications may be sent electronically, including by email or WhatsApp.

52.4 Electronic acceptance, payment and Booking Confirmation may be used as evidence of the agreement.

53. GOVERNING LAW AND DISPUTE RESOLUTION

53.1 These Terms and each Booking are governed by the laws of the Republic of Indonesia.

53.2 The parties will first attempt to resolve any dispute in good faith through direct discussion.

53.3 If the dispute cannot be resolved amicably, it will be submitted to the competent courts of Indonesia, subject to any mandatory consumer rights or jurisdiction rules that cannot lawfully be excluded.

53.4

54. GENERAL PROVISIONS

54.1 If any provision of these Terms is invalid or unenforceable, the remaining provisions will continue to apply.

54.2 A failure or delay in enforcing a provision does not constitute a waiver of that provision.

54.3 Ocean Mantra Village may use employees, contractors and Third-Party Providers to perform parts of the Booking but remains responsible to the extent required by law.

54.4 These Terms, together with the Booking Confirmation, Cancellation & Refund Policy and any expressly agreed special terms, constitute the agreement between Ocean Mantra Village and the Guest.

54.5 Any amendment to a confirmed Booking must be agreed in writing.

54.6 Ocean Mantra Village may update these Terms for future Bookings. The version accepted at the time of Booking applies to that Booking unless the Guest expressly agrees otherwise.

54.7 If these Terms are provided in more than one language, the English version will prevail to the extent permitted by applicable law.
